In response to a request from the NJLP's Prempted Ordinance Project, the Borough of Florham Park has announced its intention on the repeal of its Loitering Code. The invalid nature of their ordinance was pointed out to them way back in 2010.

Scott Eveland and the Borough Council seeking repeal of § 150-2 of the Borough Code together with other code provisions that attempt to regulate "street conduct."  Also attached is then-Borough Administrator Nancy Gage's undated letter in which she indicated that the Borough agreed with my position and "will be introducing Ordinances to effect these changes in the new year."Despite a dozen years having elapsed, I note that § 150-2 is still in the Borough's code.  Do you think that you could have your present Borough Attorney review the matter and draft the necessary repealer?Thank you very much for your attention to this matter.
